Beatnickel Terms and Conditions

Version 2.1 • Effective from 1 November 2026

https://beatnickel.com/terms

These terms of use describe your use of Beatnickel, rights to content and how we handle reports and complaints. Beatnickel is a free music platform at its launch in Denmark.

1 Contracting party and acceptance

Beatnickel is provided by Beatnickel ApS, company registration number CVR 35414169, Hirsevej 11, 4040 Jyllinge, Denmark, contact support@beatnickel.com. These terms apply to your account and the features you use after accepting them. The terms are presented during account creation and you must actively accept them. You can save the terms and obtain a copy by contacting us.

Public browsing does not require an account. A person or business is not bound by these terms merely because Beatnickel has created a curated profile about them. Rights under data protection rules apply independently of acceptance.

2 What Beatnickel offers

Beatnickel is a platform for discovering live music and connecting audiences, musicians, bands, artists, music professionals and music places. Places may include venues, studios, rehearsal rooms, music schools and music shops. Depending on the features available, you can follow profiles, express interest in Events, administer profiles, create Opportunities, send applications and communicate with others.

Features may be restricted by role, permission, geography or launch phase. A description of a forthcoming feature is not a promise of a particular launch date. Any specifically agreed features and statutory rights remain in effect.

Beatnickel launches in Denmark on 1 November 2026. The service is free and no purchases or paid subscriptions are offered at launch. Accordingly, no separate purchase terms apply to this version.

3 Age account and representation

You must be at least 15 to create an account. If you are under 18, you must have the permission of your parent or guardian required by applicable law. You must not independently undertake paid subscriptions or other obligations you are not entitled to enter into.

You must provide accurate information about your identity and authority to represent others. Artist names may be used provided they do not mislead about identity or affiliation. An account is personal; do not share one time codes or login access. Use the separate administrator roles for shared administration.

You must protect access to the email address you use for login and notify us immediately if you suspect unauthorised access. You are not automatically liable for every action carried out by an unauthorised person; liability is determined under applicable law and the specific circumstances.

4 Profiles administrator roles and Claim

An account may be associated with several roles and identities. A Band profile, an Artist profile and a Place profile may be separate even when connected. Administration permissions apply to the specific profile and role.

You may only request Claim or administer a profile if you are authorised to represent the relevant person, group or business. We may require relevant documentation and pause a request if there is a dispute. Claim provides access to administration on Beatnickel and does not in itself establish ownership of a name, trademark, business or music rights.

We may refuse or revoke access where authority to represent is lacking, where there is misrepresentation or where there is a documented dispute. We provide reasons and an opportunity for review under section 10. A profile must not be left without a valid responsible administrator when the rules for that profile require one. When leaving, you must assist with a legitimate transfer.

Claim does not automatically delete the profile’s source history. Retention of personal data in the history is governed by the privacy policy and the law. You must respect the rights of other members and administrators and must not use access to take over material to which you have no rights.

5 Curated profiles and external information

We may create curated music profiles and Event information based on lawfully available public information from venues’ websites. This is the only category of external sources at launch. A curated profile does not mean the person described has an account, is a Beatnickel partner or has approved the information. Status and any verification are accurately described on the profile.

You can request a correction, report an infringement of rights or request an assessment of removal at support@beatnickel.com. You do not need Claim to do this. Basic factual information about a venue, for example its name and business address, is normally retained where there is a lawful basis. This does not limit rights to rectification, objection or erasure of personal data, or the claims of other rights holders. Each request is assessed individually.

6 Your content and rights

You retain the rights you hold to content you upload. You must have the necessary rights and permissions for text, images, music, recordings, logos and personal data. The fact that material is online or displayed on another platform does not in itself give you the right to upload it to Beatnickel.

For content you choose to publish, you grant Beatnickel a nonexclusive licence, free of charge, to store, copy, technically adapt and display it in the countries where the service is available, to the extent necessary to provide Beatnickel. Technical adaptation includes, for example, changing image size and file format. Providers may process the material on our behalf for the same purpose.

For private messages, applications and other restricted content, permission only covers necessary processing and delivery to authorised recipients, as well as lawful support, security and handling of reports. It does not grant the right to use the content for public marketing.

Use of your content in external advertising for Beatnickel requires separate permission unless another clearly agreed or lawful basis applies. These terms do not grant general permission to sell your content or use it to train general artificial intelligence models.

The licence ends when the content is deleted from the service, except for limited necessary retention under the privacy policy, applicable law and any lawful rights of other users. Your moral rights under copyright law are respected. Beatnickel’s own design, software, trademarks and editorial material belong to Beatnickel or the relevant rights holders.

7 Permitted use

You must not use Beatnickel for illegal content, fraud, identity misuse, threats, harassment, hateful content, sexual exploitation or publication of others’ private information without a lawful basis. You must not infringe copyright, trademarks or other rights, create false events, fabricated recommendations or misleading profiles.

You must not send spam or unsolicited electronic marketing, circumvent access controls, access private Opportunities without permission, distribute malicious code or disrupt the service. Automated mass collection of personal data and copying protected content without permission are not permitted. Statutory exceptions and rights are not limited by this provision.

Content must be relevant to musical life and the features where it is shared. Legitimacy and artistic expression are assessed in context; disagreement or criticism is not in itself a breach of the rules. Do not use the service to collect sensitive information about applicants without a separate lawful basis.

8 Events tickets and agreements between users

Event information may come from organisers, users or external sources. Check important details such as time, access, age limit, price and cancellation with the organiser. An Interested action is not a ticket, reservation or binding registration unless a separate feature expressly states otherwise.

When linking to an external ticket provider, the purchase agreement is entered into with the stated seller on that seller’s terms. Beatnickel is not a ticket issuer or organiser merely by displaying an Event. We remain responsible for our own actions and obligations under applicable law.

Booking, employment, collaboration, teaching and other agreements between users are entered into directly between the relevant parties unless Beatnickel expressly assumes a different role in a separate agreement. The parties must agree on payment, tax, rights, cancellation, insurance and other relevant matters themselves. We do not guarantee any particular assignment, employment, income or collaborator.

9 Reports and moderation

You can report illegal content or breaches of these terms to Beatnickel support at support@beatnickel.com. Provide the specific link or content ID, why the content is illegal or breaches the terms and relevant documentation. Provide your name and email address and a statement that, to the best of your belief, the report is accurate and complete, where required. Statutory exceptions to requirements for identity information are respected.

We handle reports promptly, carefully and objectively. We may request further information. Where contact details are available, we send an acknowledgement and communicate the decision and relevant complaint options to the extent required by the rules.

We may remove or restrict content, restrict features or suspend or close accounts in cases of illegal content, material or repeated breaches of the rules or a specific security risk. Measures are proportionate to severity, extent, repetition, context and the user’s rights. Where appropriate, we may first give a warning or an opportunity to correct the issue. Immediate danger, serious infringements or legal requirements may require immediate action.

The affected user receives a clear statement of reasons where required and lawful, including the scope and duration of the decision, relevant facts, the legal or contractual basis, any use of automation and options to complain. We do not disclose the reporting person’s identity without a lawful basis.

We use automated tools and manual assessment to identify and handle content and behaviour that may be illegal or breach these terms. The tools support enforcement of applicable rules and security. Automated assessments may be incorrect; you can complain to support and have a decision reviewed by a staff member. We disclose any use of automation in specific decisions where the rules require this. We do not promise to check all content in advance.

10 Complaints and contact points

Complaints about moderation, Claim and account access should be sent to Beatnickel support at support@beatnickel.com with the decision reference and reasons for the complaint. We offer a free internal review and accept such complaints for at least six months after the decision. A qualified staff member assesses the complaint; it is not decided solely automatically. If the decision is wrong, we correct it without undue delay.

You retain the right to judicial review and other complaint options provided by applicable law. Where the DSA provides access to certified out of court dispute settlement, we inform you of this option in the decision.

Contact point for users and authorities: Beatnickel support at support@beatnickel.com. Enquiries may be submitted in Danish. User enquiries are handled by Beatnickel support and not exclusively by automated systems.

11 Privacy and communication

The privacy policy at https://beatnickel.com/privacy explains our processing of personal data and your rights. The cookie policy is available at https://beatnickel.com/cookies. Accepting the terms of use is not general consent to data processing. We obtain separate consent where required.

We may send necessary service messages about login, security, your account and actions you have requested yourself. Optional notifications and marketing are handled according to your settings and applicable consent rules. Messages labelled as service messages must not be used to circumvent marketing rules.

If, as an administrator or business user, you use information about others for your own purposes, you are responsible for a lawful basis, necessary information, security and deletion. Your access on Beatnickel does not automatically grant the right to export information about these people or market to them.

12 Operation changes and closure

We work to provide a stable service, but maintenance, errors and interruptions may occur. We inform users about significant planned interruptions where possible. Keep your own original files and important agreements; Beatnickel is not an agreed permanent archive.

We may change features for legitimate reasons such as security, legal requirements, maintenance and product development. Changes that materially affect an agreed service are clearly notified in advance. Statutory requirements for a valid reason, notice, information on a durable medium and the opportunity to terminate a contract are respected where applicable.

You may stop using the service and request account deletion by writing to Beatnickel support at support@beatnickel.com. Any transfer of administrator relationships is handled separately and must not prevent legally required erasure of personal data. Personal data is processed in accordance with the privacy policy. An independent curated profile is not automatically deleted with your account; requests concerning its information are assessed separately.

If the service closes permanently, we give reasonable notice and an opportunity to retrieve relevant content of your own where practically and legally possible. This does not limit rights to export, return or refunds under applicable law.

13 Liability and consumer rights

Beatnickel is liable under the general rules of Danish law and the mandatory rules that apply to you. We cannot guarantee the accuracy of all external information or the fulfilment of agreements between users. This limitation does not release us from liability for our own errors or legally required actions.

For business users, to the extent permitted by law, Beatnickel is not liable for indirect loss such as operating losses, lost profit or loss of expected assignments. This limitation does not apply to intentional misconduct or gross negligence, personal injury or liability that cannot lawfully be limited. Any separate liability cap must be agreed in a specific business agreement.

No provision limits a consumer’s mandatory rights, including relevant rights concerning the supply of digital services, defects and changes. Such rights may also apply to a service without monetary payment when the conditions for payment with personal data are met.

14 Future paid services

If Beatnickel offers paid services or subscriptions, separate purchase terms apply, which you receive before ordering. They must clearly state the total price, VAT, payment period, automatic renewal, any minimum commitment, cancellation and right of withdrawal. No trial period automatically becomes paid without a clear and valid agreement.

Where a consumer has a right of withdrawal, the legally required information and a model withdrawal form are provided. Starting to use an ongoing digital service does not automatically mean the right of withdrawal is lost. Any request for early delivery and the consequences of withdrawal are handled under the rules for the specific service.

15 Changes to the terms

We may change these terms for legitimate reasons, for example legislative changes, security, new features or changes in operation. Material changes are normally communicated at least 30 days before taking effect by email or another suitable channel, with the opportunity to save the text. Shorter notice is used only where justified by a legal requirement or necessary security measure.

Changes are not applied retroactively to completed matters. If a change requires your renewed acceptance, we obtain it. You may stop using the service before the change takes effect. Specific legal requirements for business users and consumers, including any longer notice periods and termination rights, take precedence over this provision.

16 Governing law and disputes

These terms are governed by Danish law. If you are a consumer, this choice of law does not limit the protection you have under mandatory rules in your country of residence where those rules apply. A consumer’s statutory options to bring proceedings before relevant courts are not limited.

Disputes with business users are heard by the competent Danish courts under the general rules on jurisdiction, unless otherwise validly agreed. Contact support@beatnickel.com first if you would like help resolving a dispute. This is not a condition for exercising your statutory rights.

You can contact support@beatnickel.com with a complaint. You retain all complaint options and rights to judicial review under applicable law. If a provision cannot be enforced, this does not affect the remaining terms to the extent they can lawfully remain in effect.
